DESCRIPTION

The Trustee, in compliance with Agreement CT/2A – ORD/01-JULIO-2024/VIII – A, and since the need to execute the “MRO” Competition is extinguished in accordance with the considerations indicated in Circular Letter No. 04, and based on article 58, second paragraph, section III of the Public-Private Associations Law and Base 36, section c) of the Contest Rules, informs the Contestants of the cancellation of the Contest, for all legal purposes.

The project consists of the operation, maintenance and conservation, under performance standards of the Eastern Bypass of Chihuahua.

The contract has two main components:
- Setup of "MRO" services: includes works and services necessary for the release to reach and/or continue to meet performance standards.
- Road operation: from the commissioning until the end of the contract, under the payment scheme subject to compliance with performance standards, where payment is subject to deductions if said standards are not met.

The release belongs to the concession title granted by the Ministry of Infrastructure, Communications and Transportation to the National Infrastructure Fund and has a related project in Proyectos México.

Description
Banco Nacional de Obras y Servicios Públicos (BANOBRAS) is a development bank that makes the development of infrastructure projects with high social profitability possible, by providing long term funding to private developers, and state and municipal governments, and by promoting the participation of the private sector and commercial banks.

REMARKS

According to Circular Letter No. 04, the cancellation of the Contest was carried out in compliance with Agreement CT/2A – ORD/01-JULIO-2024/VIII – A, and in accordance with the following considerations:

i. It is considered necessary to strengthen the financial situation and liquidity of the Fund.
ii. In compliance with the public policy promoted by the Federal Executive aimed at strengthening the country's public institutions such as CAPUFE, taking advantage of its technical and operational experience structure, it is considered a viable option that the operation, administration , conservation, exploitation and minor and major maintenance, including the right of way of the Bypass is carried out by said organization.
iii. Derived from the above, the need to continue with the services object of the “MRO” Contract is extinguished.
